The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 1 and 2 to re-issue his passport.

An FIR No. 99 dated 05.05.2019, under Sections 379 and 506 of IPC was registered against the petitioner at Police Station Tanda, District Hoshiarpur. The police after completing investigation filed cancellation report, however, the same came to be returned by trial court for further investigation. The matter is still under investigation. Learned counsel for the petitioner inter alia contends that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391.

Learned State counsel, who on advance notice is present in Court, on instructions from ASI Gurmeet Singh, confirms the aforesaid factual position with respect to above noted FIR. 5.

Learned counsel for Union of India, who on advance notice is present in court, in wake of statement of learned State counsel, submits that case of the petitioner would be considered and an appropriate order shall be passed within six weeks from today.

In the wake of statement of learned counsel for Union of India, petition stands disposed of.
