(Oral) This petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to regularize the petitioner's service in terms of judgment rendered by this Court in CWP No.19990 of 2012, against which LPA No.111 of 2020 has also been dismissed on 05.09.2023, Annexure P-7.

As per facts apparent on record, during pendency of contempt petition, COCP No.1653 of 2022, the respondent University has stated that the petitioner has been reinstated in service with effect from 31.10.2022 in compliance of the judgment, dated 13.03.2019, passed in the aforementioned writ petition, and his claim for regularization will be decided after decision of the appeal/LPA filed against it.

Since the LPA has already been dismissed, this Court has no reason to believe that the petitioner's case for regularization will not be decided by the University, especially when they have already undertaken to do so which is discernible from the order, dated 12.07.2023, passed in COCP No.1653 of 2022. Violation of any undertaking given to Court is itself contemptuous.

In view thereof, at this stage, there is no ground to entertain the petition.
