In the present case, after hearing learned counsel for the petitioner, on 11.09.2025, following order was passed by this Court:- "1.

Instant second quashing petition has been filed by the petitioner - Manpreet Singh, aged 24 years, for quashing of FIR No. 103, dated 14.05.2025, u/s 452, 323, 148, 149 of IPC, registered at P.S. Tanda, District Hoshiarpur (Annexure P-1).

At the outset, learned State counsel, appearing on advance notice, informs that in fact the dispute is between father and son. After investigation of the case, a cancellation report was prepared at the first instance and submitted before the learned Area Magistrate on 21.01.2019. However, on the direction of the learned Area Magistrate, further investigation was carried out, which again culminated in a cancellation report dated 21.03.2025. On objection by the complainant, the said cancellation report was once again sent for further investigation by the learned JMIC, Dasua, vide order dated 24.04.2025. The said further investigation is still pending finalization.

Learned counsel for the petitioner submits that the petitioner resides abroad and, on account of pendency of the present criminal case, he is facing hardships in obtaining visa and travelling back. It is also submitted that his passport expired in 2021 and could not be renewed due to registration of the instant case. In view of the facts and circumstances explained above by learned counsel for the petitioner as well as learned State counsel, the Investigating Agency is directed to complete the further investigation within a period of two months from today and, upon completion of all formalities, to submit its report within the aforesaid period. Once the cancellation report is filed before the learned Area Magistrate, the said Court shall take a final decision thereupon within a further period of six weeks.

On asking of the Court, Mr. Neeraj Madaan, Sr. DAG, Punjab, who is present in the Court, accepts notice for respondent No.1 - State and seeks time to get instructions and to file status report/reply, if any.

Let a copy of the complete paper book be handed over to the learned State counsel, during the course of the day. 7.

Respondent No.2 be also served through ordinary process. 8.

Let a copy of this order be supplied to learned State counsel and also forwarded to the Court of learned JMIC, Dasua, for ensuring compliance of the directions issued herein."

Today, learned counsel for the petitioner submits that a cancellation report has now been submitted before the Court concerned. Therefore, he prays that he be granted permission to withdraw the present petition, at this stage.

Dismissed as withdrawn, as this stage.
