Apprehending threat to their life as well as harassment on behalf of police officials, the petitioner has come up before this Court by filing the present petition way back in the year 2022.

On a query by this court that when they were last called by the police officials and when was last threat raised to them, petitioner could not respond. Even after interacting with petitioner on telephone, petitioner's counsel submits that they were unable to inform any such threat in between after filing of the present petition. Petitioner's counsel could not point out any specific instance of threat. 3.

Counsel for the State on instructions submits that there is no threat perception and the police officials work within the parameters of law and in case they want to investigate the petitioner, they shall do so in accordance with law. 4.

Petitioner's counsel further submits that the representation dated 30.11.2022, is still pending before the Director General of Police, Punjab, Punjab Police Headquarters, Sector-9, Chandigarh.

Given above, it is clarified that if the representation dated 30.11.2022 is not already decided, the petitioner can represent afresh to the concerned Commissioner of Police, within two weeks from today. If the petitioner files such representation within the above-mentioned time period of two weeks, then, the same shall be decided by the concerned Commissioner of Police, within two months, himself/herself. Liberty reserved to the petitioner to file fresh petition or to take other legal remedies in accordance with the law.

It is clarified that there is no adjudication on merits. It is further clarified that this order shall not come in the way if the interrogation of the petitioner is required in any cognizable case.

The concerned officer can also verify its authenticity and may download and use the downloaded copy for immediate use.
