The petitioners through instant petition under Article 226/227 of the Constitution of India are seeking direction to respondents No.5 to 10 not to interfere in the religious affairs, management and election of managing committee of Gurdwara Sahib Pehli Patshahi, Sunam Udham Singh Wala, District Sangrur during the pendency of civil suit before Learned Civil Judge (Junior Division), Sunam. 2.
The petitioners were elected as office bearers of management committee of captioned Gurdwara vide elections held on 14.05.2022. Respondent No.12 filed application on the same day before Deputy Superintendent of Police, Sunam alleging mischief in the said elections. Sub Divisional Magistrate, Sunam vide order dated 14.05.2022 intervened and constituted a seven members committee including the
-2petitioners and respondent No.12 to look after the management of Gurdwara. Naib Tehsildar, Sunam Udham Singh Wala was appointed as the Convener of the said committee. Respondent No.12 preferred civil suit before Learned Civil Judge (Junior Division), Sunam. Learned Civil Court vide order dated 22.08.2022 dismissed application for permanent injunction and directed that temporary committee shall look after the management of the Gurdwara. Sub Divisional Magistrate vide order dated 13.10.2022 appointed Naib Tehsildar as Receiver for managing affairs of the Gurdwara. Respondent No.10 in connivance with respondents No.5 to 9 is attempting to appoint respondent No.11 as the President of Managing Committee of the Gurdwara. Respondents No. 5 to 9-authorities are wrongly interfering in the affairs of the Gurdwara though civil suit is still pending.

As per replies filed by authorities, DSP Sunam submitted report on 19.08.2025 confirming that elections were conducted unanimously. On the same day i.e. 19.08.2025 SDM, Sunam passed order directing Receiver (Tehsildar, Sunam) to immediately handover records and charge of Gurdwara to newly elected committee and accordingly Receiver handed over charge to newly elected committee. 4.
The petitioners are claiming that respondent No.10-Mr. Aman Arora, Cabinet Minister is interfering in the affairs of the Gurdwara. He wants to appoint respondent No.11-Mr. Sadha Singh as President.

In view of affidavits of DSP Sunam as well as SDM Sunam and the fact that the matter is pending before Ld. ADJ, no interference of
-3this Court is warranted. The petitioners have remedy to raise all issues before Ld. ADJ including objection with respect to appointment of Committee despite interim orders.
