**** RAJ MOHAN SINGH, J.(Oral) In view of order dated 15.12.2022 passed by the Addl. Sessions Judge, Bathinda, now the case before the trial Court is fixed for 02.01.2023 for the defence evidence, if any, and arguments.

At this stage, learned counsel for the petitioner submits that trial of the case be made time bound as Lakhwinder Singh has not turned up for leading his defence evidence after grant of bail. Earlier he was found innocent during course of investigation and was summoned only with the aid of Section 319 Cr.P.C. Now after grant of bail, he has not turned up to lead his evidence, whereas the petitioner has already concluded his evidence in defence.

Learned counsel for the petitioner further submits that MOHMED ATIK 2022.12.22 18.42 I attest to the accuracy and authenticity of this order/judgment

CRM-M No.58997 of 2022 (O&M this petition may be dismissed as withdrawn with a direction to the trial Court to expedite the trial as the petitioner has already undergone more than 5 years and 9 months of incarceration. In view of aforesaid facts and circumstances, I deem it appropriate to dismiss this petition as withdrawn with a direction to the trial Court to conclude the trial within a period of three months from 02.01.2023 i.e. from the next date fixed before the trial Court.
