Senior citizen has approached this Court, being aggrieved with the order dated 09.07.2019 (Annexure P-3), whereby, the application filed under Section 22 of The Maintenance and Welfare of Parents and the Senior Citizens Act, 2007 (hereinafter referred to as 'Act 2007') seeking eviction of respondent-Rampati, and her children from the house in question, and the application was dismissed through an order dated 09.07.2019. 2.

This Court has put a specific query to the learned counsel for the petitioner, about the maintainability of the instant petition by confronting the learned counsel for the petitioner with a judgment passed by Division Bench of this Court in Babu Lal Sharma vs. Sushila Devi and others (LPA No.701 of 2018) decided on 15.12.2025.

Learned counsel for the petitioner is unable to rebut that the proceedings under Act 2007, is not maintainable against daughter-in-law. He is further unable to cite any contrary judgment to support the view taken by the Division Bench of this Court.
