Prayer is for grant of anticipatory bail in case FIR No.58 dated 16.07.2017 under Sections 447,323,506,201,195 IPC registered at P.S Cheema, District Sangrur.

As per allegations, co-accused Jarnail Singh @ Kala and Jaggi are alleged to have given gandasa and soti blows respectively to the injured. Learned counsel states that after presentation of challan, the complainant appeared before the trial Court and deposed against the petitioner. Thereafter, on application under Section 319 Cr.P.C having been moved by the prosecution, the petitioner has been summoned as an additional accused. He further states that the challan was presented only against co-accused Jarnail Singh @ Kala and that the name of the petitioner was kept in column No.2. It is contended that the petitioner has wrongly been summoned to face the trial.

CRM-M-50809 of 2019 #2# account the facts of the present case, this petition is disposed of with the observation that the petitioner may appear before the learned trial Court on or before the date fixed. On his doing so, he shall be enlarged on bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect.
