Challenge in the instant revision petition is to the order dated 19.09.2019 passed by the learned Civil Judge (Jr. Divn.), Gohana, whereby the application of the petitioner for appointment of Local Commissioner was dismissed.

The dispute between the parties pertains to alleged encroachment and dispossession of property in dispute. The learned Civil Judge has rightly dismissed the application for appointment of Local Commissioner for demarcation of the property in dispute as it would virtually amount to assisting the revisionist/plaintiff to procure evidence in his favour with the assistance of the court. Needless to say that the court cannot come to the rescue of either of the parties as every party has to stand on its own legs.

Dismissed in limine.
