In the High Court of Punjab and Haryana at Chandigarh .....

Cr.W.P. No.1230 of 2019 (O&M) .....

Date of Decision:28.11.2019 Amarjot Kaur and another ... Petitioners

Versus

State of Punjab and others ... Respondents .....

CORAM: HON'BLE MR. JUSTICE AMOL RATTAN SINGH

Present:

Mr. Vikram Jeet Singh, Advocate, for the petitioners. .....

AMOL RATTAN SINGH, J. (Oral) By this petition, as the petitioners seek protection of their life and liberty at the hands of respondents No.4 to 6, and therefore, are not asking of the production of anybody in Court, it is not understood as to why a writ in the nature of Habeas Corpus has been sought. Obviously, the petition in that form is not maintainable, yet, keeping in view the fact that it has been filed invoking jurisdiction under Article 226/227 of the Constitution, the petition is disposed of with a direction to the Senior Superintendent of Police, Khanna, District Ludhiana (respondent No.2) as also the S.H.O., Police Station Samrala, District Ludhiana (respondent No.3), to ensure that the life and liberty of the petitioners is duly protected, such being their fundamental right under Article 21 of the Constitution of India.

Cr.W.P. No.1230 of 2019 (O&M) [2] It is, however, obviously made clear that the validity of the marriage of the petitioners is not being commented upon in any manner whatsoever by this Court.
