(Oral) The petitioner has approached this Court under Articles 226/227 of the Constitution of India, for setting aside the possession notice dated 12.09.2018 (Annexure P-3) issued by the respondent Bank for taking the possession of the secured assets. Further prayer for issuing direction to the respondent Bank for not taking the possession of the commercial shop of the petitioner and give some time till the date of registry as per agreement dated 30.01.2019, has been made. A further prayer for staying the operation/implementation of order dated 12.09.2018, during the pendency of the present writ petition, has also been made. 2.
Learned counsel for the petitioner states that after the filing of the present writ petition, the necessary relief has been granted by the respondentBank. Accordingly, a prayer was made that he may be allowed to withdraw the present writ petition.
