******* SURINDER GUPTA, J.(Oral) The petitioner seeks emergency parole for the marriage of his son, fixed for 14.12.2019 at Gill Palace, Patran Road, Samana. Learned State counsel submits that fact of marriage of son of petitioner has been verified. However, he opposes the grant of parole to the petitioner on two grounds; firstly, that earlier, he was declared proclaimed offender in three cases and secondly, on his released on parole in case bearing FIR No. 178 dated 18.12.2002 registered at Police Station Dharamkot, he had not surrendered before the jail authority within stipulated period.

On perusal of reply, I find that the petitioner was involved in 18 cases, out of which he has been acquitted in 09 cases and convicted in remaining cases. This fact has not been denied that he had not surrendered before the jail authority after his release on parole in case bearing FIR No. JYOTI 2019.12.05 11:34 I attest to the accuracy and integrity of this document

Despite the above facts but keeping in view that petitioner has to attend the marriage of his son, which in a life time occasion, I find reasons to release him on parole so as to enable him to attend the marriage functions. This petition is allowed. The petitioner is allowed parole from 11.12.2019 to 17.12.2019, subject to his furnishing personal bond and surety bond to the satisfaction of District Magistrate, Moga. He will also furnish a fixed deposit of `50,000/- in the name of District Magistrate, Moga which will be released to him on his surrender i.e. after expiry of period of parole.
