Present writ petition has been filed by the petitioner - workman, for seeking modification of the award dated 19.07.2023 (Annexure P-2), passed by the learned Industrial Tribunal, Bathinda - respondent No.1 (in short, 'learned Tribunal').

Learned Tribunal while dealing with the reference No.22/2021, held that the termination of the workman is illegal, and therefore, ordered for reinstatement. However, claim qua back-wages, has been denied by the learned Tribunal. Hence, present writ petition. 3.

This Court has noticed that workman was terminated from the service in July, 2017, and the claim statement before the learned Tribunal was filed on 20.07.2021.

On being asked by this Court in specific, whether in the claim statement, petitioner - workman pleaded of not gainfully employed during this period anywhere, to which, learned counsel for the petitioner - workman clarifies that there is no such pleading in the claim statement. In view of the facts & circumstances of the case, this Court does not find any infirmity or illegality in the impugned award dated 19.07.2023 (P-2), passed by the learned Tribunal, qua not granting back-wages to the petitioner - workman.
