**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 65 dated 26.3.2009 under Section 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Rattia, District Fatehabad. Learned counsel for the petitioner submits that though the alleged contraband recovered from the petitioner falls under the commercial quantity but the petitioner has been in custody since 26.3.2019 and challan has been presented. He further submits that there is no assertion in the FIR that the police party was having any printer along with them but the report under Section 50 of the NDPS Act, alleged to be thumb marked by the petitioner, is a typed one.

Learned State counsel, on instructions from ASI Radhey Shyam, submits that challan has been presented in the Court but charge has not been framed yet.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
