Prayer in the instant petition is for quashing of order dated 09.07.2025 (Annexure P-4) passed by the learned Additional District and Sessions Judge, Fazilka in case bearing FIR No.0095 dated 23.08.2023, under Sections 18, 29, 61 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Bahawala, District Fazilka whereby regular bail granted to the petitioner was cancelled and his bail bonds and surety bonds were ordered to be cancelled and forfeited to the State. 2.

Learned counsel for the petitioner contended that the petitioner had noted down a wrong date and due to this, he failed to appear before the trial Court on 09.07.2025 but on that day, the case was fixed for prosecution evidence and no prosecution witness was present. However, exemption application filed by the other co-accused was allowed by the trial Court but the bail/surety bonds of the present petitioner were cancelled and forfeited to the State. Mr. Subhash Godara, Additional Advocate General, Punjab, accepted notice on behalf of respondent-State. 5.

The petitioner is directed to surrender before the trial Court within two weeks i.e. upto 27.09.2025 and move an application for bail. The trial Court is directed to decide the same in accordance with law. Till then, arrest warrant of the petitioner shall remain in abeyance in this matter. If the petitioner fails to appear before the trial Court, within the stipulated period i.e. upto 27.09.2025, then the relief granted by this Court shall be deemed to be withdrawn 7.
