After arguing for some time, faced with a situation, that application for condonation of delay in filing the appeal was dismissed and consequently, the appeal was dismissed but no decree was drawn, learned counsel for the appellant submits he be allowed to withdraw the present appeal with liberty to take appropriate action as per law. Dismissed as withdrawn, with liberty aforesaid. In case, proceedings are initiated well in time, then period spent for pursuing this appeal be set off.
