******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.181 dated 29.07.2019 registered for the offence punishable under Section 61 of Punjab Excise Act, 1914, at Police Station Tanda, District Hoshiarpur.

Heard.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case as he was not apprehended with illicit liquor at the spot.

As per case of prosecution, recovery of 204 bottles of illicit liquor was effected from the motorcycle of petitioner, which he left at the spot on witnessing the police party and ran away. Keeping in view the above facts and that identity of the petitioner is not disputed, I find no reason to grant exercise the discretionary power of this Court to extend the benefit of anticipatory bail to the petitioner. Judgments Annexure P-2 and P-3 placed on file by the petitioner is of no help to the petitioner in any manner. This petition has no merits. Dismissed.
