This is an application for withdrawal of the main appeal on the ground that the award has since been complied with and the entire amount stands paid to the claimants.

Notice of the application.

Mr. Robin Lohan, Advocate, who is present in Court, accepts notice on behalf of the non-applicant/respondent Nos.2 and 3 and states that he has no objection if the application is allowed. He has also confirmed that the amount has since been received by the claimants. With the consent of both the counsel, the main case is taken on board today itself.

Learned counsel for the appellant states that the award passed by the Tribunal has since been complied in its totality and, consequently, seeks permission to withdraw the present appeal. It is further prayed that the statutory amount of Rs.25,000/- be directed to be refunded since the entire amount already stands paid to the claimants. Learned counsel for the respondent Nos.2 and 3 has no objection to the aforesaid prayers being granted. In view of the above, the present appeal is dismissed as withdrawn. The statutory amount of Rs.25,000/- deposited at the time of filing of the appeal be refunded.
