The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 27.10.2023 (Annexure P-3) whereby petitioner has been blacklisted for three years. 2.

Learned State counsel, who on advance notice is present in Court, at the outset, submits that petitioner has preferred appeal against impugned order and appeal would be decided within ten days from today. 3.

Faced with this, counsel for the petitioner seeks permission to withdraw the instant petition with liberty to pursue matter with the appellate authority.
