The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to issue passport.

The petitioner has applied for passport. An FIR No. 84 dated 15.05.2010, under Sections 307, 341, 323, 34 of IPC, at Police Station Sadar, Ferozepur, District Ferozepur, was registered against the petitioner. The petitioner was convicted vide judgment dated 19.05.2017. The petitioner was awarded sentence of three months under Section 323 of IPC. The petitioner has preferred CRA-S-2241-SB of 2017 before this Court which is still pending. The sentence of the petitioner has been suspended. The petitioner was involved in another FIR No. 132 dated PARAMJIT KAUR SAINI 2023.11.15 17:43 I attest to the accuracy and authenticity of this order/judgment

CWP No.25598 of 2023 -2- 2023:PHHC:144598 26.05.2008, under Sections 326, 325, 324, 323, 427 of IPC, registered at Police Station Ferozepur, District Ferozepur in which he was acquitted vide judgment dated 11.03.2015 passed by ACJM, Ferozepur. 3.

Learned counsel for Union of India submits that passport authority has received adverse police report, thus, passport was not issued. The petitioner may be asked to appear before passport authority alongwith requisite documents. If the petitioner appears before the passport authority alongwith requisite documents, the case of the petitioner would be considered and decided in terms of judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391  In the wake of statement of learned counsel for Union of India, the petitioner is directed to appear before passport authority on 06.12.2023 alongwith all requisite documents relating to the aforesaid FIRs. The passport authority, thereafter, would pass an appropriate order within six weeks.
