RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to petitioner-Palwinder Singh, in case FIR No. 180 dated 01.10.2019 registered under Section 22 of the NDPS Act at Police Station City Patti, District Tarn Taran. According to the prosecution, the petitioner was apprehended with conscious possession of 1800 intoxicant tablets, without any permit or licence.
Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Learned State counsel has not been able to refute the submission of learned counsel for the petitioner. He submits that despite sending reminder to the Forensic Science Laboratory on 13.01.2020, the report has not been received, so far.

CRM-M-51189-2019 -2In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail, subject to his furnishing personal bonds and two sureties of Rs.2.00 lakh, to the satisfaction of Special Court concerned only till receipt of the FSL report. The petition stands disposed of accordingly.
