(ORAL) In the present case, the petitioner is seeking the relief that even though he worked as a professor from 20.06.2009 till the date he superannuated on 31.01.2016, but actually he was paid the salary equivalent to the post of reader. Even the pensionary benefits of the petitioner has been calculated keeping in view the salary equivalent to the post of reader and not that of a professor, from which post he superannuated on 31.01.2016.

Petitioner claims that once he had discharged the duties of the post of professor and on the date of retirement, he worked as professor, he is entitled for the salary equivalent to the post of professor on 20.06.2009 till the date he superannuated as well as fixation of his pensionary benefits by treating him as professor. CWP-32579-2018 -2Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served respondents with a legal notice on 14.09.2018 (Annexure P-15), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 14.09.2018 (Annexure P-15) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
