Through the instant petition, a challenge is thrown to the award dated 04.04.2025 (Annexure P-2) passed by the Industrial Tribunal-cum-Labour Court, U.T. Chandigarh, wherethrough, the claim of the petitioner for grant of promotion to the post of TG-1 (Mechanic) w.e.f. 02.11.2021, from the date his juniors were promoted has been denied, and further prayer is made that he may be granted the benefit of promotion.

A perusal of the award reflects that the reference was answered against the workman on the ground that the effected parties have not been impleaded in the array of respondents. Respondent No.1, who has caused appearance before this Court, on an advance notice by this Court, submits that, they have no any objection, if the case is remanded back to the Tribunal subject to the condition that the petitioner would implead all the effected parties in the array of respondents therein.

Learned counsel for the submits that he will pursue the matter before the learned Tribunal concerned, after taking requisite steps by impleading the effected parties in the array of respondents. 4.

In view of the consensus that has been arrived at between the parties, the impugned award (Annexure P-2), is hereby set aside, and the matter is remanded back to the Industrial Tribunal-cum-Labour Court, Chandigarh, subject DEEPAK KUMAR 2025.09.18 09:42 I attest to the accuracy and authenticity of this document P & H High Court, Chandigarh to the condition that the petitioner shall take all effective steps, in accordance with

C.W.P. No. 27017 of 2025 law, for impleadment of all the effected parties in the array of respondents. In case the petitioner moves to the learned Tribunal, as per undertaking given herein, the latter shall decide the matter in accordance with law. 5.

Disposed of accordingly.
