The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name of Petitioner(s) FIR No.

From the contents of the FIR, it is not clear as to which of the two accused, on seeing the police team, placed the transparent polythene packet on the bench and then immediately stood up and attempted to run away from the spot.

Recovery from the said polythene packet is of 15 grams of 'Heroin', which is three times the small quantity, yet much below the threshold of non-commercial quantity, i.e., 250 grams. There were earlier two other cases against the present petitioner, Rajkumar @ Raj Singh @

Present petitioner along with co-accused Balwinder Singh alias Bittu, have been acquitted of the charges levelled against them, vide judgment of 12.01.2021, passed by Ld. Judge, Special Court, Faridkot.

Sessions Case No.NDPS RT-10, dated 25.08.2020/21.06.2019, titled as, "State v. Raj Kumar alias Ranjha"

Ld. Judge, Special Court, Faridkot, vide judgment of conviction and order of sentence dated 12.11.2021, convicted the petitioner u/s 21 of NDPS Act, and sentenced him to undergo R.I. for a period of one month along with fine amount of Rs.500/-, and in default of payment of fine, further R.I. for 7 days.

However, the period of detention, already undergone by the convict (petitioner herein) during course of investigation, enquiry and trial, was ordered to set off against the sentence of imprisonment imposed upon him.

It is relevant to mention that in the aforesaid conviction case, where the petitioner was sentenced to one month rigorous imprisonment, he was subsequently released as the sentence had already been undergone. Furthermore, investigation in the present case is stated to be taking considerable time, as the final report has not yet been submitted before the Court concerned.

Since the recovered quantity of 'Heroin' is only 15 grams, coupled with vague allegations, as it is yet to be established in whose conscious possession the contraband was found, this Court finds no substantial reason to detain the petitioner further in custody for an indefinite

Accordingly, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case.

Needless to observe that the petitioner shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly.

The observation made here-in-above shall not be construed as an expression of opinion on the facts of the case and the Trial Court is expected to decide the case on the basis of complete evidence available on record.

It is further made clear that if, in future, petitioner is directly found indulged in similar kind of activities, this order shall be deemed to be cancelled.

Petition stands disposed of.
