-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed under Article 226 of the Constitution of India praying for grant of 8 weeks parole to the petitioner under Section 3(1)(c&d) of the Punjab Good Conduct Prisoners (Temporary Release) Act, 1962.

Learned counsel for the petitioner while praying for parole would submit that mother of the petitioner is unwell and there is no one else to look after her.

A reply has been filed by the respondent-State in which it is stated that after filing of this petition in the year 2019, the petitioner was released on parole for a period of 8 weeks, as per order of Deputy Commissioner, Hoshiarpur on 23.04.2020 and he was directed to return on 19.06.2020, however, due to corona virus, the petitioner returned to Central Jail, Gurdaspur only on 19.08.2021 and is now currently lodged in Central Jail, Hoshiarpur since 07.09.2021.

CRWP No.1339 of 2019 (O&M) -2contend that parole that the petitioner had availed of was for the period of 2020 and therefore, he would be entitled to parole in this petition, which was filed in the year 2019.

I have heard learned counsel for the parties and find no ground to allow parole to the petitioner on the ground that he would be entitled to the same, as the petition had been filed in the year 2019. As per the reply filed by the respondent-State, parole was allowed to the petitioner during the pendency of these proceedings by an order dated 23.04.2020 and he has recently returned to jail only on 19.08.2021. Consequently, the instant petition stands dismissed.
