The present appeal has been filed by claimant No.2 seeking enhancement of compensation of Rs.12,63,800/- awarded by the learned Motor Accident Claims Tribunal, Rohtak, vide Award dated 29.04.2015 passed in Claim Petition No. 100 dated 26.03.2013 filed under Section 166 of the Motor Vehicles Act, with the delay of 3695 days in filing the appeal; and 47 days in refiling the appeal.

After arguing for some time, when learned counsel for the applicant/appellant is unable to convince this Court either for condoning the delay or for enhancement of compensation, he submits that he may be permitted to withdraw the present petition.
