By way of present petition filed under Article 226/227 of the Constitution of India, petitioner has sought a direction to the respondents to accept the payment of deficit stamp duty to the extent of petitioner's liability as per Sale Deed No.396, dated 07.05.2015, Annexure P-1. 2.
At the outset, counsel for the petitioner submits that petitioner is not impugning order dated 30.11.2021, Annexure P-3, whereby, appeal filed by her under Section 47-A of the Indian Stamp Act, 1899, was declined by the Commissioner, Ropar Division, Ropar. He submits that petitioner has purchased the land along with another person, her share in the total purchase is 1/6th, and she is prepared to deposit the stamp duty, proportionately. He submits that petitioner has moved a representation dated 15.04.2022, Annexure P-4, to the authorities, requesting them to accept her share, but the same is still pending. Given the nature of order proposed to be passed, this Court does not deem it necessary to call for a response from the respondents. 6.
Without examining the averments and claim of the petitioner, writ petition is disposed of with a direction to the Additional Deputy Commissioner (G), SAS Nagar (Mohali) - respondent No.2, to look into the representation, Annexure P-4, and take a final decision thereon within a period of two months from the date of communication of copy of this order.
