(Oral) This petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to allow the petitioners to participate in the process for allotment of permanent stations to the 2017 batch. Further, direction has been sought to allot the petitioners permanent place of posting by allowing them to participate in the process initiated by the respondents as per their merit obtained in the selection.

Learned counsel for the petitioners submits that grievance raised herein is pending for appropriate decision before the respondents. At this stage, the petitioners will be satisfied in case respondent No.2 is directed to decide the pending representations, dated 04.07.2023 and 18.08.2023, Annexure P-8, in a specified period.

Mr. Sanjeev Kaushik, Addl. AG, Haryana, appearing on advance notice, itself notices and contends that the petitioners were allotted Mewat Cadre on their request vide order dated 16.05.2022, Annexure P-7. Since it is apparent on record that other similarly placed employees who have allotted the Mewat Cadre, were allowed to come back to Rest of Haryana Cadre by cancelling their allotment vide order dated 10.06.2022, Annexure P11. Therefore, the petitioners' representation will also be considered in the light of this order.

In view of the statement made, learned counsel for the petitioner has no objection to the petition being disposed of in terms thereof with a direction to respondent No.2/Director, Elementary Education, Haryana, to consider and decide the pending representations dated 04.07.2023 and 18.08.2023, by passing a speaking order in accordance with law, within a period of two weeks from the date of receiving a certified copy of this order. 6.

In case the order is not passed within the stipulated period, the officer concerned shall pay costs of ₹25,000 to the petitioners.
