Ms. Subhpreet Kaur, Advocate, for the petitioner. **** HARKESH MANUJA, J.(ORAL) By way of present revision petition, a prayer has been made for issuance of direction to the trial Court for expeditious disposal of the Civil Suit No.345 of 2017 titled as Jashanjot Kaur Vs. Charanjit Singh and others (Annexure P-1) pending before the Court of Civil Judge (Sr. Divn.), Sangur.

Brief facts of the case are that petitioner/plaintiff filed a suit for declaration claiming ownership over the suit property based on inheritance from his deceased father Teja Singh. The suit was filed on 14.06.2017 and issues were framed thereafter on 03.02.2021. Referring to the medical records pertaining to the petitioner, learned counsel for the petitioner points out that the petitioner is suffering from cancer of stage-IV and has been undergoing chemotherapy + antiangiogenic agents and she is at last stage of her life.

I have heard learned counsel for the petitioner and gone through the medical records produced along with present revision petition which clearly depicts that the petitioner/plaintiff is suffering from gallbladder cancer of stage IV and appears to be at the last leg of her life and in case the prayer made in the present revision petition is allowed, she may be able to at least see the final outcome of this ANIL KUMAR 2022.12.21 15:12 I attest to the accuracy and integrity of this document

CR-6062-2022 (O&M) litigation initiated at her instance. Accordingly, keeping in view the peculiar facts and circumstances of this case as well as the serious medical condition of the petitioner, the present revision petition is disposed of with a request to the trial Court to decide the Civil Suit No.345 of 2017 titled as Jashanjot Kaur Vs. Charanjit Singh and others, preferably within a period of 6 months from today. It is made clear that in case the petitioner/plaintiff herself prays for adjournment for no valid reason and just to delay the proceedings in the suit, the aforesaid direction shall not remain operative.
