By way of this petition filed under Section 438 CrPC, petitioner prays for grant of anticipatory bail in case FIR No.156 dated 12.09.2023 registered at Police Station Nehianwala, District Bathinda, under Section 420 IPC.

According to the prosecution allegations, petitioner entered into an agreement dated 23.11.2020 to sell his land @
16 lakh per acre in favour of the complainant. He also received an amount of
14 lakh as earnest money. The target date for registration of the sale deed was fixed to be 30.04.2022, which was extended to 02.05.2023 with common consent. However, later on, petitioner did not execute the sale deed. Complainant came to know that by playing fraud upon him, the petitioner had already transferred the land in favour of his son Navjot Singh on 03.03.2022. It is contended by ld. counsel that petitioner has been falsely implicated; that matter is of civil nature regarding the recovery of
14 lakh with interest and that in fact he had not executed any agreement. 4.

After hearing ld. counsel for the petitioner, this Court does not find the present case to be a fit case for grant of anticipatory bail. Before the target date fixed for execution of the sale deed, petitioner transferred the land in favour of his son, which brings in the criminal element, prima facie revealing the commission of cheating by the petitioner with the complainant.

As such, present petition for grant of anticipatory bail stands dismissed.
