(ORAL) This petition has been filed under Section 439(2) read with Section 482 Cr.P.C., for cancellation of regular bail granted to respondent No.2 by an order dated 06.11.2018 in FIR No.786 dated 07.10.2018 under Sections 365, 506 & 34 of IPC, 1860 and Section 8 of POCSO Act, 2012 registered at Police Station Shivaji Nagar, District Gurugram. Notice of motion had been issued in the said petition as far back as on 13.12.2018 and thereafter, the matter was taken up on 14.03.2019, 31.07.2019 and 06.09.2019, on which dates, no one has put in appearance on behalf of the petitioner.

Reply has been filed by the learned counsel appearing on behalf of the respondent-State wherein it would reflect that the custody of the prosecutrix is with her parents.
