The present regular second appeal pertains to the year 2020 and the same is still at the stage of preliminary hearing inasmuch as notice in the application for condonation of delay as well as notice of motion is yet to be issued. On 26.07.2023 none had appeared on behalf of the appellant and the case was adjourned to 28.11.2023. On 28.11.2023 again none had appeared on behalf of the appellant and the case was adjourned to 18.03.2024. Yet again on 18.03.2024 none had appeared on behalf of the appellant however, on the basis of a written request for an adjournment circulated on behalf of the arguing counsel for the appellant on the ground that he was admitted in the hospital, the case was adjourned to today. 2.

Today again despite the matter being called twice since morning, none has put in appearance on behalf of the appellant. It appears that the appellant is not interested in pursuing the present appeal. AMAN JAIN 2025.01.31 09:12 I attest to the accuracy and integrity of this order/judgment

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 4.
