The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to appoint him as legal guardian of his father Mr. Harish Chand Jain for managing his personal and financial affairs including bank accounts, moveable and immovable properties, investments and other assets. 2.

The petitioner claims that his father since 2023 is in vegetative state. His mother and two sisters have no objection if he is appointed legal guardian of his father-Mr. Harish Chand Jain. As per judgment of this Court in <Surekha Vs. Axis Bank and Ors.=, 2025 SCC OnLine P&H 3402 the petitioner may be appointed as legal guardian of this father. He is ready to comply with parameters/guidelines laid down in aforesaid judgment.

Learned counsel for the respondents No.3 to 5 submits that he has no objection if petitioner is appointed legal guardian of Mr. Harish Chand Jain. It is apt to notice here that respondent No.3 is wife of Harish Chand Jain and 4 and 5 are his daughters.

Learned State counsel submits that as per Surekha (supra) the respondent has to constitute a medical board to ascertain physical and mental condition of Mr. Harish Chand Jain. The competent authority would constitute medical board and thereafter needful would be done as per aforesaid judgment.

In the wake of statement of all the stakeholders, the petition stands disposed of with a direction to competent authority to constitute medical board within two weeks from today.

The Court is sanguine that authorities would thereafter proceed in accordance with law.
