PANKAJ JAIN, J. (ORAL) This is a petition filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.492 dated 19.10.2022 registered under Sections 186, 332, 353, 379A, 506 and 34 of the Indian Penal Code, 1860 at Police Station Sector-27, Sonipat, District Sonipat. 2.

Ld. Counsel for the petitioner submits that the petitioner has been falsely implicated on the basis of complaint made by a police official who has misused his office. Whole of the family has been roped in including the mother of the petitioner who is 83 years of age. He further submits that surprisingly the allegation was w.r.t. snatching of the mobile whereas the same was recovered from the place of occurrence after 10 days and not from the possession of the petitioner. So far as the allegations w.r.t. beatings are concerned the same are not supported by any medical evidence.

Ld. State Counsel is not in position to dispute the aforesaid factual assertions made by counsel for the petitioner on the basis of record. 4.

Having heard counsel for the parties and after going through the records of the case, without going into the merits of the case, the present petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
