Mr. Svetanshu Goel, Advocate for the respondent. *** By way of filing the present application, applicant Rupinder Kaur seeks transfer of petition under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights filed by her husband Charanjit Singh against her having title 'Charanjit Singh Vs. Rupinder Kaur' pending in the Court of Additional Civil Judge (Sr. Division), Phillaur, District Jalandhar to the Court of competent jurisdiction at Jalandhar.

Both the Courts that is the trial Court where petition is pending presently and the Court where the transfer is sought are within Sessions Division, Jalandhar. Learned District and Sessions Judge, Jalandhar is competent to deal with such type of transfer application. The applicant has approached this Court directly without first approaching learned District and Sessions Judge, Jalandhar in that regard.

The application is dismissed relegating the applicant to the remedy of approaching learned District and Sessions Judge, Jalandhar at the first instance. (H.S.
