*** This petition for regular bail has been filed by petitioner Randhir Singh, an accused in F.I.R. No. 80 dated 4.6.2019 under Sections 392, 394, 397, 201, 120-B IPC and Section 25 of the Arms Act, 1959 registered with Police Station Babain, Kurukshetra. Briefly stated the facts of the case as per prosecution story are that on 2.6.2019 complainant Girdhari Lal, a scrap dealer was travelling in a Canter bearing registration No. HR-56-4832 loaded with scrap being driven by Randhir Singh-driver (present petitioner). He had gone to Gobindgarh (Punjab). On the next day at about 6 P.M. they were returning from Mandi Gobindgarh and complainant was having Rs.2,10,000/- with him as sale price of scrap which money he had kept behind the driver seat after wrapping it with a cloth. While they were going from Shahbad to Ladwa, two persons came on motorcycle and intercepted the truck. One of them pointed gun towards the complainant and took out money and thereafter they ran away.

CRM-M-51127 of 2019 After registration of the F.I.R the matter was investigated. Involvement of Randhir Singh in the incident was found. He was arrested on 5.6.2019. On conclusion of investigation the challan had been filed against the accused and they are facing trial. I have heard learned counsel for the petitioner and learned State counsel besides going through the record.

During the course of trial statement of Girdhari Lal complainant has been recorded in which he has not supported the case of the prosecution with regard to Randhir Singh-driver. Rajbir and Sanjeev Kumar co--accused of Randhir Singh are stated to have been granted regular bail by this Court.

Accordingly, I find it proper and appropriate if similar concession is granted to the present petitioner Randhir Singh. Therefore, this petition is accepted. Petitioner Randhir Singh is ordered to be released on bail on his furnishing bail bond and surety bond to the satisfaction of the learned trial Court/CJM/Duty Magistrate, Kurukshetra. However, it is made clear that in case the petitioner is found indulging in any criminal act at a later stage, his order granting bail is liable to be withdrawn. (H.S.
