(ORAL) Present petition has been filed under Section 407 Cr.P.C. seeking transfer of the trial titled as "State of Punjab vs. Rubina Singh" in case FIR No.3 dated 7th of January, 2018 registered for the offences punishable under Sections 406 and 420 of the IPC, 1860 at Police Station Dasuya, District Hoshiarpur from JMIC, Hoshiarpur to JMIC, Ludhiana. 2.

On 18th of January, 2023 the following order was passed : "Short reply by way of affidavit of Balbir Singh, Deputy Superintendent of Police, Sub Division Dasuya, District Hoshiarpur has been filed. The same is taken on record. There is no representation on behalf of the petitioner. In the interest of justice, the matter is adjourned to 14.8.2023.

On 18th of August, 2023 again none appeared to represent the petitioner and the following order was passed : "No one has put in appearance on behalf of the petitioner. Prior thereto also on 16th of March, 2022, the petitioner remained unrepresented.

In view of above this Court finds that the petitioner is not interested in pursuing the present petitioner and as stated by counsel representing the respondents the trial has already proceeded considerably as three prosecution witnesses already stand examined. 6.

In view of above, the present petition is ordered to be dismissed.
