HARSH BUNGER, J. (Oral) The applicant/appellant filed a complaint under Section 138/142 of Negotiable Instruments Act against the respondent herein, which came to be registered as criminal complaint No.RRT/326/2018 (NACT/2736/2013). The said complaint was dismissed vide judgment dated 17.09.2018 passed by Judicial Magistrate First Class, Kaithal and resultantly, the respondent herein was acquitted. Accordingly, the instant application has been filed under Section 378(4) of Cr.P.C seeking leave to appeal alongwith appeal. This matter was listed on 07.03.2019, when no one had appeared on behalf of the applicant. Same was the position on 28.01.2020. On 30.11.2022, there was no representation on behalf of the applicant and the matter was adjourned for today i.e. 20.03.2023 and the Registry was directed to notify the counsel for the applicant. As per office report, learned counsel for the applicant has been informed regarding listing of the case, through e-mail.
