(ORAL) Prayer in this petition is for grant of anticipatory bail in FIR No.248 dated 25.07.2022 under Sections 323, 325, 342, 506, 34 IPC, registered at Police Station Sadar Kanina, District Mahendergarh. Learned counsel for the petitioners, at the very outset, submits that the FIR was registered after a delay of 23 days of the incident and as a counterblast, FIR No.223 dated 02.07.2022 was registered against the complainantparty. It is further submitted that since the victim has suffered fracture, without prejudice to their right of defence, the petitioners are ready to pay Rs.25,000/- to the victim towards the medical expenses incurred by him. CRM-M-59601-2022 -2On asking of the Court, Mr. Himmat Singh, DAG, Haryana accepts notice on behalf of the respondent-State and on instructions from ASI Babu Lal, could not dispute that there is a delay of 23 days in registration of the present FIR and FIR No.223 already stands registered against the complainant-party. After hearing learned counsel for the parties and considering the fact that the petitioners have volunteered to pay Rs.25,000/- to the victim towards the medical expenses, present petition is allowed and the petitioners are granted the concession of anticipatory bail subject to the conditions envisaged under Section 438 (2) Cr.P.C.
This will, however, be subject to the condition that the petitioners will hand over a demand draft of Rs.25,000/- favouring victim Rambir, to the Investigating Officer, who will further hand over the same to the victim.
