CRM-M- 59660 of 2022 The petitioner, through the instant petition under Section 482 Cr.P.C., is seeking direction to official respondents to conduct fair and impartial investigation in FIR No.113 dated 28.09.2016, under Section 67 of Information Technology Act, 2000 and Sections 342, 354(c), 384, 389, 120-B and 473 IPC, registered at Police Station Dehlon, District Ludhiana.
Learned counsel for the petitioner inter alia contends that on the complaint of petitioner, FIR was registered against four persons. The police after completing investigation, filed challan dated PARAMJIT KAUR SAINI 2023.02.20 18:09 I attest to the accuracy and authenticity of this order/judgment
CRM-M-59660 of 2022(O&M) -230.11.2017. Respondent No. 4 was shown as proclaimed offender in the challan, however, no proceedings till date have actually been initiated under Section 82 Cr.P.C. declaring the respondent as proclaimed offender. Respondent No. 4 is roaming freely. Learned State counsel, on instructions from ASI Rupinder Singh, states that police is unaware of whereabouts of respondent No. 4 and if petitioner furnishes details of respondent No. 4, the investigating officer would take appropriate steps. In view of statement of learned State counsel, the petitioner is directed to furnish particulars/whereabouts of respondent No. 4. This Court is sanguine of the fact that on furnishing of particulars/whereabouts of respondent No. 4 by the petitioner, investigating officer would take appropriate steps. No further order is warranted.
