Present petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name of Petitioner(s) FIR No.

FIR in the present case was got registered by complainant - Raghav Mehra, and the version of FIR reads as under:- "

Stated that I am a permanent resident of the above mentioned address and I am studying in MLN College Yamunanagar, we are three brothers. My elder brother is Dinesh and younger one is Madhav who lives abroad in Dubai. My father Suresh Mehra age 53 years does his private job. My mother Praveen Maihra lives at home. We have our own car no. HR26BK-3868 Marca Karuj. Yesterday On 03-02-2024, around 8-

- 2 - 30 pm, I and my friend Saharan alias Sera, resident of Sasoli Road, Yamunanagar, had gone to Kamani Chowk in my car for food and drink. After some time, we both had food and came back. I had left him outside his house. When I was coming back, on the way, I met my friend Gagan S/O Shivkumar, resident of Vikas Nagar, Yamuna Nagar. Gagan sat in my car, we both stopped in the car outside my house,. Then some boys in the car came with iron rods and swords and started vandalizing my car. When I got down, they beat me badly. They hit me with rods on my left leg and also hit me with rods on both my arms. My father came out of the house. When he came out into the street, they hit my father on the head with a rod. When my mother came out, they also beat up my mother, Praveen Maihra.

Hearing the noise, when the neighbor came out and After giving threat the boys by seeing the people of the locality ran away in the car. At the same time, when there was no arrangement for an ambulance, they took me and my father in their vehicles and brought me here to Civil Hospital Yamuna Nagar. I came to know that my father's condition was worse and he was referred to PGI, Chandigarh. I had done it but my father is admitted in Raj Hospital Yamuna Nagar. My brother got checked the CCTV cameras in the neighborhood and this incident happened at 9-30 in the night. Boys came in car no. HR10-Z- 2812 Marca Swift white, 4 boys in them. Manga Khan Kashapur Manni Jat resident Pandyo, Manjot Sidhu, Sadhaura and another boy got out of the car and attacked us with rods, Without any reason they attacked me and my family and threatened to kill me.

Given, legal action should be taken against them, I have got my statement written, okay SD Ragav Mehra."

Status report dated 09.03.2026, has been filed by learned State counsel in Court today, which is taken on record. Office to tag the same at appropriate place.

A copy thereof has been handed over to the counsel for the petitioner.

As per FIR, no specific injury has been attributed to any of the accused, namely, (i) Gurnit @ Deenu, (ii) Manpreet @ Manni (petitioner herein), (iii) Mohd. Saif @ Manga Khan, (iv) Nitin Kumar, (v) Saurabh, and

- 3 - (vi) Manjodh Singh.

However, as per CCTV footage, three accused were seen coming out of the car at the spot, and the petitioner was armed with an iron rod. As per the status report, there are eight other cases registered against the petitioner, and in two of them, he has already been convicted. 5.

Accused - Saurabh and Manjodh Singh are yet to be arrested. The petitioner is inside the jail for the last about 01 year and 10 months. Statement of injured - Suresh Mehra (father of the complainant - Raghav Mehra) has already been recorded. However, complainant - Raghav Mehra is yet to appear for his deposition.

Faced with the situation, learned counsel for the petitioner seeks permission to withdraw the instant petition at this stage. 7.

Dismissed as withdrawn at this stage.
