 ( ) "1. Through the instant petition, as instituted under Section 438 of the Cr.P.C., the petitioner has sought the concession of anticipatory bail, in case FIR No.54 dated 24.05.2023, under Sections 326, 323, 324, 452, 427, 34 of the IPC, registered at P.S. Kathunangal, District Amritsar.

2. The allegations, as carried in the instant FIR, are that in a quarrel, which took place inter se the complainant party and the accused party, who rather are neighbours, the petitioner inflicted a Datar injury on the ring finger of right hand of the complainant, which constituted a grievous injury, thereby attracting the provisions of Section 326 of the IPC.

3. Considering the fact that the instant FIR is the result of an altercation between neighbours, as also the fact that the petitioner is not involved in any other criminal case, this Court deems it appropriate to, at this stage, grant the asked for relief.

5. Mr. Karunesh Kaushal, A.A.G, Punjab, accepts notice on behalf of State of Punjab.

6. The learned State counsel, on instructions from ASI Rashpal Singh, intimates this Court that one of the co-accused in the instant FIR, namely, Bir Kaur has been enlarged on regular bail by the learned trial Court concerned, while one of the co-accused, namely, Sunny has been granted the concession of anticipatory bail by the learned Sessions Judge concerned.

7. In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 438(2) Cr.P.C."
