HARSH BUNGER, J. (Oral) Prayer in the present petition is for setting aside the order dated 22.11.2022 (Annexure P-7), passed by the Judicial Magistrate First Class, Chandigarh in Crl. Misc.-2073-2022, titled as "Ripu Daman Sharma and others Vs. Amrik Singh and others", vide which the application filed at the behest of respondents No.2 and 3 under Section 156(3) Cr.P.C., for issuance of directions to the SHO, Police Station Sector-49, Chandigarh to register FIR against the petitioner, has been allowed without calling any status report from the concerned Police Station, which is totally illegal and arbitrary in the eyes of law, along with all the consequential proceedings initiated thereon from the aforesaid order (Annexure P-7). In pursuance to the notice of motion order, Mr. Yuvraj Singh Rathore, Addl. PP. UT, Chandigarh appears and submits that the FIR No.72 AMANDEEP GOSAIN 2022.12.22 20:16 I attest to the accuracy and integrity of this document
-- dated 29.11.2022 registered under Sections 420, 467 and 120-B of IPC at Police Station Sector 49, Chandigarh already stands registered. As per the statement made by learned State counsel, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition.
