The present revision petition has been filed for issuance of direction to learned Rent Controller to expedite the hearing (preferably day to day hearing).
Learned counsel for the petitioner submits that rent petition is pending since 2017 and not much progress has been made. In the light of the submissions, so made, I have gone through the contents of the status report, furnished by the Presiding Officer. Perusal of the same reveals that no doubt, there was earlier delay, on the part of the respondent, for conducting the cross-examination, but however, the same has been completed by learned Lower Court. Now, the case is still at the stage of recording of the evidence of the petitioner. However, it is solely on account of list of witnesses, having furnished by the petitioner, at a later stage, the delay has occurred. Now, the official witnesses are to be examined at the behest of the petitioner.

2023:PHHC:164553 CR-6814-2023 Since the list of witnesses was filed at a later stage, for summoning of witnesses, at this stage, no case is made out for issuance of time bound direction to learned Lower Court. But anyhow, learned Lower Court shall sensitize itself and conduct the proceedings, expeditiously. Accordingly, the revision petition stands disposed of.
