KARAMJIT SINGH , J. (Oral) By this petition filed under Section 439 Cr.P.C., the petitioners seek the concession of regular bail.

Heard.

As per the allegations appearing on the record, Bikkar Singh, Jagga Singh and Jeet Kaur, wife of Jagga Singh, called Ajaib Singh, brother of complainant-Sukhdeep Singh at about 09:30 p.m. on 15.08.2019. Then Jagga Singh and Kala Singh along with two-three other persons came to the house of Bikkar Singh, to beat him. On this, Bikkar Singh came to the house of the complainant. All the accused including both the petitioners also tress-passed into the house of the complainant. Complainant tried to rescue Bikkar Singh. In the meantime, Ajaib Singh gave gandasa blow on the back side of head of the complainant. Both the petitioners armed with wooden sticks also caused injuries on the person of the complainant, as a result of which, he fell down.

CRM-M-51676-2019 -2The accused also gave fist blows to the complainant and also slapped him. During the investigation of the case, petitioner No.1-Jagga Singh was arrested on 06.10.2019 while petitioner No.2-Labh Singh was arrested on 08.10.2019. Presently, both the petitioners are lodged in judicial custody. The injured-Sukhdeep Singh has been discharged from the hospital. Learned counsel for the complainant brought to the notice of the court that compromise has been effected between the parties and a copy of the compromise deed is Annexure P-2, which is already placed on record by the petitioners. The said compromise deed is bearing signatures of the complainant/injured-Sukhdeep Singh.

In these circumstances, no purpose will be served by keeping the petitioners in custody for any further period. Thus, without commenting on the merits of the case, this petition is allowed and the petitioners are directed to be released on regular bail on their furnishing adequate bail and surety bonds to the satisfaction of the concerned Chief Judicial Magistrate/Duty Magistrate.
