The present petition has been filed under Section 12 of the Contempt of Courts Act, 1971 alleging that 'issuance of a speaking order dated 09.06.2025 (C-2) signifies a deliberate action done with an evil intent or with bad motive or purpose and is covered in the settled law by the Hon'ble Supreme Court of India and amounts to be a contempt of court.' It has been stated in the petition that the speaking order (C-2) does not comply with the order dated 12.03.2025 (C-1) passed by this Court in CWP-6885-2025. 2.

Briefly the facts relevant to the present lis are that the petitioner herein along with others filed a writ petition being CWP-6885-2025 which was decided by this Court vide order dated 12.03.2025 (C-1). The operative part of the order dated 12.03.2025 reads as under : '4. On the asking of the Court, Mr. T.P.S. Chawla, Senior Deputy Advocate General, Punjab, who is present in

-2Court, accepts notice on behalf of the respondent-State and submits that in case, the legal notice dated 03.02.2025 (Annexure P-19) has been received in the office of the concerned authorities and the same is still pending consideration with the authorities concerned, the same will be decided by the competent authority within a period of eight weeks from the date of the receipt of certified copy of this order by passing an appropriate speaking order. Learned counsel further submits that in case, it is found feasible to accept the claim of the petitioners, the same will be accepted, otherwise due reasons will be mentioned for not accepting the claim of the petitioners in the speaking order to be passed and the said order will be duly conveyed to the petitioners.

5. Learned counsel for the petitioners submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further'.

The petitioner along with others had also filed a contempt petition being COCP-2759-2021 titled as 'Suresh Kumar & Ors. Versus Sarvjit Singh & Ors.' which was disposed off by this Court vide order dated 27.11.2024. A speaking order dated 09.06.2025 was passed which has been appended with the present contempt petition as Annexure C-2.

The present contempt petition has now been filed making various allegations that the said speaking order has been passed in disregard of law and that there are various reasons given for willful omission in the speaking order. Subsequently, another speaking order dated 18.11.2025 was passed which has been appended with the reply filed by way of a short affidavit dated 14.01.2026 of Sh. Jitender Pal Singh, Chief Engineer, Headquarter, Department of Water Resources, Chandigarh. The petitioner is still aggrieved stating that the speaking order is not in consonance with the settled principle of law and that the respondents are guilty of perjury as they have stated wrong facts.

A perusal of the order dated 12.03.2025 (C-1) reveals that the only direction to the respondents was to decide the legal notice dated 03.02.2025. This Court, while exercising jurisdiction under the Contempt of Courts Act, 1971, is not required to go into the merits or demerits of the order passed. The order dated 12.03.2025 (C-1) passed by this Court stands complied with in letter and spirit.

In view of the above, no further orders are required to be passed in the present contempt petition and the same is accordingly dismissed. Pending applications, if any, also stand disposed off. 8.
