The petitioner through instant petition under Article 226 of Constitution of India is seeking setting aside of order dated 12.10.2023 (Annexure P-4) whereby Appellate Authority has dismissed appeal of the petitioner.

Learned State counsel, who on advance notice is present in Court, submits that the petitioner has preferred second appeal before the Appellate Authority. He assures the Court that the Appellate Authority would decide appeal of the petitioner within 10 days from today. 3.

Faced with this, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to pursue his grievance before the Appellate Authority.

In the wake of statement of learned counsel for the parties, the petition stands disposed of.
