Sr. No.: 106 Civil Writ Petition No.29302 of 2024 Date of Decision: October 28, 2024 Swati Kumari ..... PETITIONER(S)

VERSUS

State of Haryana & others ..... RESPONDENT(S)

CORAM:

HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA PRESENT: - Mr. Ankur Sheoran, Advocate, for the petitioner. Mr. K.K. Chahal, Additional Advocate General, Haryana. Tribhuvan Dahiya, J (Oral) CM No.17742-CWP of 2024 Application is allowed.

Leave to file petition is granted.

Main Case The petition has been filed seeking a writ of mandamus directing the respondents to release the dues for the period of maternity leave to the petitioner from 17.07.2018 to 16.10.2018 alongwith interest. 2.

Learned counsel for the petitioner contends that the petitioner was working as Extension Lecturer in the College at the time she proceeded on maternity leave, but salary for that period was not given to her. He does not deny that she is no longer working as Extension Lecturer, and has joined as teacher in a Government School in 2020.

3.

Apparently, the claim for dues of maternity leave period has been raised by the petitioner after inordinate delay of about six years. There is no explanation forthcoming for this delay. Even the representation referred AVIN KUMAR 2024.10.29 09:57 I attest to the accuracy and integrity of this judgment/order.

CWP No.29302 of 2024 [2] to by the learned counsel has been filed by her only on 16.09.2024, Annexure P-4. Therefore, the petition is not maintainable on account of delay and laches. 4.

Dismissed.
