(ORAL) CM-2962-CII-2025 The present application under Section 151 CPC has been filed for placing on record copies of Civil Suit No.649 of 2022 titled as 'Raj Welding Works and another Vs. Municipal Corporation and another' along with zimini orders, copy of Civil Appeal No.CMA/61/2022 dated 10.11.2022 filed by the Municipal Corporation, Panchkula, along with zimini orders, a letter dated 13.03.2024 issued by the Deputy Municipal Commissioner, Municipal Corporation, Panchkula and order dated 25.11.2024 passed by the Commissioner, Municipal Corporation, Panchkula, as Annexures P-7 to P-10, respectively.

-2For the reasons mentioned in the application, the same is allowed and Annexures P-7 to P-10 are taken on record. 1.

The present contempt petition has been filed for deliberate and intentional disobedience of order dated 09.01.2024 passed by this Court in CWP-28186-2023.

This Court had issued the following directions in CWP-281862023, vide its order dated 09.01.2024:- "In view of the submissions made by learned State counsel, the present petition is disposed of with a direction to respondent No.3 i.e. the Commissioner, Municipal Corporation, Panchkula to decide the case expeditiously in accordance with law keeping in view the policy dated 20.07.2016 (Annexure P-20) and other relevant laws applicable in this case within a period of three months from today."

In compliance of the order dated 09.01.2024 passed by this Court in CWP-28186-2023, speaking order 25.11.2024 (Annexure P-10), which is filed by the petitioner along with the application i.e. CM-2962-CII2025, has been passed by the Commissioner, Municipal Corporation, Panchkula.

In view of the above, since order dated 09.01.2024 passed by this Court in CWP-28186-2023, has already been complied with, therefore, the present contempt is purged and rule stands discharged.

Needless to say that the petitioner is at liberty to avail remedy as is available to him in accordance with law to challenge the speaking order 25.11.2024 (Annexure P-10) passed by the Commissioner, Municipal Corporation, Panchkula.
