***** ARCHANA PURI, J. (Oral) At this stage, counsel for the applicant submits that the petition under Section 9 of Hindu Marriage Act, which is sought to be transferred, has since been dismissed in default.

In the given circumstances, he does not want to pursue with the transfer application and the same be dismissed as withdrawn, with liberty to file fresh one, subject to the revival of the petition under Section 9 of Hindu Marriage Act.
